These Terms of Use govern your access to and use of the EverLMS platform and the Food Safety & HACCP Compliance Training Program. By creating an account, accessing the service, or continuing to use the platform, you agree to be bound by these Terms and any policies referenced herein. If you do not agree, do not use the service. The terms apply to all users including administrators, instructors, and learners. For clarity, references to the platform include the website, mobile applications, APIs, and any related services. We grant you a limited, non exclusive, non transferable license to use the service solely for authorized training purposes in accordance with these Terms. You may not reproduce, distribute, repurpose, reverse engineer, or create derivative works from the content except as expressly allowed by you or as provided by the platform. You may assign or transfer your account only with prior written consent from EverLMS. You agree to provide accurate registration information and to maintain confidentiality for your login credentials. You acknowledge that violations of these terms may result in suspension or termination of the account and loss of access to training records. The platform may include third party content and links to other sites; we provide those solely for convenience and do not endorse them. You agree to use the service in compliance with all applicable laws and regulations including data protection, consumer protection, and export controls. We disclaim warranties to the fullest extent allowed by law and we do not guarantee uninterrupted or error free operation. In no event shall EverLMS be liable for indirect, special, incidental, or consequential damages arising from use of the service. You agree to indemnify and hold harmless EverLMS and its affiliates from any claims arising out of your misuse or violation of these Terms. We may modify the Terms from time to time; continued use after changes constitutes acceptance of the revised terms. If a dispute arises, you agree to submit to binding arbitration rather than court proceedings, except for certain small claims or actions permitted by applicable law. The governing law for these Terms shall be the law of the jurisdiction where EverLMS operates, without regard to conflict of law rules. We may collect diagnostic data to improve the service and may share data with service providers to support operation; you consent to such processing by using the service. If you are a business customer, additional terms may apply, and in that case the agreement between your organization and EverLMS governs. By using the service you acknowledge your responsibilities to safeguard learner data and to ensure training is used in a compliant, ethical, and safe manner. We may suspend access for maintenance or emergencies with reasonable notice when feasible, and we may terminate accounts that violate these Terms. You agree that any disputed issue will be resolved under the dispute resolution mechanism described here and that nothing in these Terms restricts the rights of either party to seek injunctive relief in appropriate circumstances. These terms are intended to be read as a whole and are governed by applicable law; if any provision is found unenforceable, the remaining provisions shall continue in full effect. You acknowledge that any trademarks, logos, or proprietary materials on the platform remain the property of their respective owners and that your use of those materials is governed by these Terms and any license sections provided by EverLMS. By continuing to use the platform you confirm you are authorized to access the services as described and that you will not attempt to circumvent any built in safeguards or breach system security.
